Fanataqe provides informational content focused on berry farming (strawberries and blueberries), including seasonality in Ireland, handling considerations, and educational frameworks for evaluating farming projects. Farming and market outcomes vary due to factors outside our control, including weather, disease pressure, labor availability, input costs, and market pricing.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Fanataqe Limited, its directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, business interruption, or reputational harm, arising out of or relating to your access to or use of the Site.

To the extent Fanataqe is found liable for any claim, our total direct liability will be limited to the amount paid by you to Fanataqe in the 12 months preceding the event giving rise to the claim, or 100 EUR, whichever is lower. If you have not paid any amount, the cap will be 100 EUR.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited or excluded under applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Fanataqe Limited and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) any content you submit through the Site.

The Site may reference third-party services or resources for educational purposes. Fanataqe is not responsible for the content, accuracy, availability, or practices of external websites or services. Your interactions with third parties are governed by their own terms and policies.

11. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to the Site are governed by the laws of Ireland, without regard to conflict of laws principles. You agree that the courts of Dublin, Ireland will have exclusive jurisdiction over any dispute, claim, or proceeding arising out of or relating to these Terms or your use of the Site.

12. Dispute Resolution

Before initiating formal legal proceedings, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. You may send a written notice describing the dispute to [email protected] and include sufficient detail for us to investigate and respond.

If the dispute is not resolved within the 30 day informal period, either party may bring the dispute to the courts specified in the Governing Law and Jurisdiction section.

13. Termination

Fanataqe may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or if your use poses a security risk or legal exposure. We may also remove or restrict access to content where required for compliance or operational reasons.

The following sections will survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, Dispute Resolution, and any other provisions that by their nature should survive.
